The following Terms and Conditions apply exclusively for all services provided through www.cepsports.com (hereinafter “web shop”/"website").

1.   Preamble

medi GmbH & Co. KG, Medicusstraße 1, 95448 Bayreuth, Germany (hereinafter “medi”/”we”/”us”) is a global company that produces and sells a broad range of medical devices, health products, fashion articles and sports apparel. Sports products are sold under the CEP brand.
The web shop is operated by or on behalf of medi, making medi your contractual partner when you conclude a contract via the web shop.

2.   Conclusion of Contract

2.1. You can select your preferred language in the header area of this web shop operated from Germany.
 
2.2. The presentation of products in our web shop does not constitute a legally binding offer; it is merely an online catalog of products subject to availability that are presented to consumers.  
 
2.3. To place orders in the web shop you must have full legal capacity or the consent of your legal representative. Orders placed for the purpose of resale are prohibited. You assure that the information you provide to us through requests or purchase orders is correct and complete.
 
2.4. By clicking the “Buy” button you are placing a binding order for the items in your cart. Acceptance of the contract takes place through order confirmation via email or delivery of the goods.

3.   Prices

3.1. All prices include VAT and are quoted in euros (€). Prices are subject to change but this does not affect orders that have already been placed.
 
3.2. medi may limit or discontinue special offers or discounts at any time.
 
3.3. medi is entitled to charge shipping costs. The costs of shipping vary depending on the product and shipping method. You will find more information on this in the web shop under the section “Shipping and Charges”. Shipping costs are shown separately and added to the total amount of your order.

4. Payment Options

4.1. The following payment methods are accepted in the web shop:
 
  • Purchase on account up to an invoice total of max. €200,
  • Credit card,
  • PayPal or
  • SOFORT banking.
4.2. If you choose “Purchase on account” we will perform a creditworthiness check via Creditreform Boniversum GmbH, Hellersbergstr. 11, 41460 Neuss to verify information such as your address and credit data including a score determined using statistical methods, provided we have credibly demonstrated our legitimate interest.
 
4.3. If we are required by law or at our discretion to issue or make invoices available, we reserve the right to issue or make electronic invoices available, and you agree to this form of invoicing.

5.   Retention of Title

The delivered goods remain the property of medi until full payment of the total amount including shipping costs.

6. Warranty

 
6.1. The statutory provisions apply to the warranty. For the remainder, we do not provide a quality or durability warranty.
 
6.2. Please observe the care instructions on the product labels. You will find more information on this here in the web shop under the section “Care Instructions”. 
 
6.3. We are not liable for damage due to improper handling of the products including unintended use.

7. Delivery

7.1. The delivery of goods takes place via parcel service or forwarding. medi is authorized to make partial deliveries in justified cases. The goods are insured during transport by the insurance coverage of the parcel service provider or forwarder.

Unless expressly arranged with us in deviation to this, the online shop, its content and all associated rights remain the exclusive property of medi or its licensors.

medi is not responsible for the content or presentation of linked third-party websites. This also applies in particular to the product images and descriptions used on this website in cases in which these have been provided by manufacturers or other third parties.

11. Place of Performance

Bayreuth is the place of performance for all contractual obligations.

12. Law and Jurisdiction

These Terms and Conditions are subject to the laws of the Federal Republic of Germany. German law applies to purchase contracts under the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). This does not affect the validity of applicable laws in accordance with the law of the country in which you live or have your place of business.
 
Jurisdiction is determined by the procedural rules applicable in the claimant’s country

13.2. Amendments to the Terms and Conditions
 
We reserve the right to change these Terms and Conditions at any time. The use of this web shop and all purchase contracts between you and us are subject to the medi Terms and Conditions valid at the time of your order via the web shop or on the day you visit the web shop. Please check the Terms and Conditions periodically for updates.
 
13.3. Severability Clause
 
Supplements, additions and/or amendments to the contract are not valid unless they have been set out in writing. The same applies to the conclusion of any cancellation contract. Should one of the provisions of this contract be or become ineffective or impracticable, then this shall not affect the validity of the remainder of the supply contract. In such cases, the contractual parties agree to replace the ineffective or impracticable provision with an effective or practicable provision that corresponds as closely as possible to the contractual parties’ economic interests.
